Storm Jocelyn: Drivers warned car insurance claims may be invalid due to little-known rule

Drivers have been warned that car insurance claims made as a result of Storm Jocelyn may not be valid because of a little-known rule.

The second storm to hit the UK in a week is expected to bring high winds, heavy rain, and severe flooding that could swamp towns and villages up and down the UK.

As a result, there is a high likelihood that hundreds of cars could be caught up in the flood waters, forcing owners to make a claim on their insurance.

However, car expert and CEO of BigWantsYourCar.com Peter Waddell has warned that drivers may not be able to make a claim on their insurance because of a rule in their contracts.

Mr Waddell warned that while insurance may cover some drivers in a selected set of circumstances, it may not cover them if they have deliberately put their car at risk.

Mr Waddell explained: “Insurance coverage may be at risk if drivers knowingly engage in risky behaviour during a flood, such as intentionally driving through flooded areas against advice.

“Failure to adhere to safety precautions outlined by insurers during extreme weather conditions could potentially compromise the validity of your claim.”

Mr Waddell added car insurance policies will still cover someone’s car if it was not knowingly put in a position of danger. He said: “Comprehensive motor insurance policies generally cover flood-related damages, including engine failure, malfunctioning brakes, and upholstery damage.

“Knowing the extent of your coverage is important to ensure financial protection in the event of a flood. Flood cover typically encompasses repairs or replacement costs for vehicles damaged by unavoidable floods, like those occurring at your usual parking spot. Differentiating between unavoidable and avoidable flood damage is key.”

Mr Waddell said it was key for drivers to understand their insurance policies and that it was better for them to have comprehensive rather than third-party insurance.

He said: “Comprehensive policies offer better protection against flood damage, but it’s essential to review policy details to ensure your car is adequately covered. After storms like Jocelyn, immediate contact with your insurance provider is vital.

“Timely reporting enables a quicker assessment of the damage, and insurers can guide you on processing claims efficiently.”

Mr Waddell’s comments came as Storm Jocelyn arrived in the UK and high winds began to batter the UK just hours after Storm Isha had swept over the country, bringing with them heavy rain.

A spokesperson for the RAC told the BBC that driving conditions would be “very challenging” with “debris on the roads”.

They added: “We urge drivers to consider postponing their journeys in these areas if at all possible.

“Those that do need to drive should try to avoid exposed coastal routes where strong winds will make driving much more difficult.”
