A man buried the bodies of a mother and her two-year-old daughter under the floor of his home in Dundee, he has admitted – but is denying murder.
Andrew Innes, 52, admitted to killing Bennylyn Burke, 25, and her daughter Jellica, but claimed diminished responsibility for their deaths.
Mr Innes is now standing trial for the accusation of murder, which he denies.
He is also accused of sexually assaulting Jellica Burke and attempting to defeat the ends of justice.
He faces a further charge of raping another child, and has pleaded not guilty to all charges.
At the start of the trial at the High Court in Edinburgh, a join minute of agreed evidence between prosecutors and Innes’ defence team was read to a jury.
This is evidence which has been agreed between prosecutors and Innes’s legal team as being uncontroversial.
According to a post-mortem examination detailed in this evidence, Bennylyn’s death was the result of a single stab wound to the chest and blunt force head injuries.
The court was told by junior prosecution counsel Frankie Morgan that Innes had caused Bennylyn’s death by stabbing her with a knife and repeatedly hitting her on the head with its handle, as well as with a hammer.
Two year old Jellica died of asphyxiation.
According to Mr Morgan, Mr Innes then put their bodies in rubble bags before hiding them in concrete underneath his kitchen floor.
